REQ OFFICER TO RESPOND TO RIO FOR A GROUP OF KIDS REF SEX BATTERY, THERE IS A GROUP OF STUDENTS THAT CAN'T KEEP THEIR HANDS TO THEMSELVES ON THE BUS - 95P2 REQ TO GET AHOLD OF DOUG, PLS GET ETA FROM DOUG BACK TO RIO VISTA - 1039 TO KIM, SHE WILL TRY TO GET AHOLD OF DOUG - PER KIM, DOUG ADV'D HE HAD A CONVERSATION W/SOMEONE THAT THEY WOULD RESPOND TO TRANSPORTATION - PER KIM, DOUG IS ON A ROUTE WON'T BE BACK UNTIL 3:30 - TRANS / SPEAK TO DOUG- I was dispatched to Rio Vista School located at 13590 Havasu Rd, Apple Valley CA, 92308 regarding a possible sexual battery between three students that occurred [EDIT] 4th grade students [redacted] (M1) [redacted] (M2) and [redacted] (M3) , and. For the remainder of this report all students will be referred to as M1, M2, and M3. The following is a summary of the incident and statements provided to me. I spoke to Principal Kelly Poff inside of her office where she told me it was reported to her by [EDIT] (Rio Vista Teacher) that the mother of M2, reported to her M1 was touching M2 "private parts" on the school bus while going home after school. I called M2 inside Poff's office to speak with her. When speaking with M2, she told me she is friends with M 1 and M3. M2 has known M1 since the 3rd grade and they share a class together. I asked M2 if she ever had a crush, or currently has a crush on M 1. M2 said they used to like each other in the past but never got into a dating relationship. I asked M2 if she knew what it meant to have a boyfiiend and she told me yes. M2 told me having a boyfiiend means to love each other, hug and hold hands. I asked M2 if M 1 has ever touched her inappropriately touched her and she said yes. M2 said M 1 touches her on her privates pointing to "here, here, and here". I asked M2 when she pointed to her chest if she mean her breast, and she said yes. I asked M2 if when she pointed to her lap, if she meant her vagina, and she said yes. I asked M2 if M3 has ever touched her inappropriately in the same places M 1 has, and she said yes. I asked M2 to tell me about the last time M1 and M3 touched her and she told me on [EDIT] on the bus. M2 said she was sitting by the window and M2 was in the middle, and M3 was at the end of the seat. M2 said M 1 grabbed her hand and placed in on his private part I asked M2 if she means penis when she says private part and she said yes. M2 said M 1 told her he was getting a "Boner" but did not know what that was. M2 said M 1 started touching her on her vagina and would not stop after being told too, and M3 started touching her too on the vagina. M2 told me the touching was not wanted and told both M1 and M3 to stop. I asked M2 if M1 and M3 touched her vagina above her clothing or under her clothing. M2 told me she was touched by both M1 and M3 above her clothing. I asked M2 if she had ever touched M 1 in an inappropriately way and she told me no. I did not have any further question M2 and my interview was concluded. I spoke with M3 inside Poff's office where he told me he is no longer friends with M1 because he has been touching M2 inappropriately on the school bus after school. M3 told me him, M 1 and M2 were sitting with each other on the incident date. M2 was by the window, M1 was in the middle, and he was at the end of the seat. M3 said M1 grabbed M2 hand and placed it on M1 penis above the clothing. I asked M3 if he has ever touched M2 inappropriately and he told me no. I did not have any further questions for M3 and my interview was concluded. I spoke with M1 inside Poff's office where he told me he was best friends with M3 and good friends with M2. M1 said they last saw each other on the bus the day of the incident. I asked M1 if he has ever touched M2 inappropriately and he told me no. I asked M1 ifhe knew the difference between right and wrong, and if he knew lying was wrong. M 1 told me he did not right from wrong and knew it was wrong to lie. I asked M 1 if he lied to me about inappropriately. touching M2 on the bus and he said yes. M1 started crying and saying sorry. M1 told me M3 forced him to touch M2 on the vagina and grab her hand and put it on her penis. M 1 said M3 was going to pay him money for what he was doing to M2. M1 told me he grabbed M2 by her hand and placed it on top of his penis and then touched her on the vagina. I asked M1 when he touched M2, if it was above the clothing or under the clothing. M 1 told me above the clothing. I did not have any further questions for M1 and my interview was concluded. I drove to the AVUSD Transportation Yard and spoke with Doug Smith. [EDIT] The video shows M2 sitting next to the window, M1 in the middle, and M3 at the end of the seat. From the hours of 1540 hours, M1, M2, and M3 were inappropriately touching each other. M3 grabs M2 by her face and acts like he is going to kiss her but stops. At approximately 1550 hours, M1 grabs M2 right hand and places in on his penis above the clothing and gropes himself. At approximately J 555 hours, M2 grabs M1 hand and places it back on his penis and moves in an up/down motion. At approximately 1556 hours, M3 touches M2 on her vagina above the clothing, and again at 1559 hours, but moves his hand back and forth several times before stopping. Throughout the video M1, M2, and M3 are seen acting inappropriately touching each other on the penis and vagina above the clothing. M1 and M2 are seen grabbing the seat of the bus and humping it while making faces. Based off my investigation the crime of sexual battery is unfounded. Discipline for school to handle regarding inappropriate touching.

Rio student has not been picked up from school. School attempted contact with mother/father and no answer. Contacted grandfather and said he does not have a vehicle to pick student. - Made contact at juvs home address. Spoke with grandparents who were able to get into contact with juvs mother. Juves mother contacted me via cell phone and said she fell asleep and was on her way to pick juv up from school. I arrived to Rio vista and met with mother who took care and custody of her child.

OCCR'D YESTERDAY - STUDENT THREATENED ANOTHER STUDENT SAID WOULD BRING A KNIFE / STUDENT WAS SEARCHED AND NO KNIFE FOUND AND STUDENT SAID SHE NEVER SAID THAT TO THE STUDENT / YESTERDAY AFTER SCHOOL FATHER OF TEXTED MOTHER OF AND SAID HE WOULD "END THIS TODAY" / IS TAKING AS A THREAT AND ADV'D SCHOOL, PER SCHOOL IS HOT HEAD AND CONCERNED HE WILL COME TO SCHOOL TODAY AND CAUSE TROUBLE - 95P6 REQ TO TRY AND RUN FATHER - I MADE CONTACT WITH THE MOTHER OF [redacted] STATED HER SON AND [redacted] USED TO DATE AND HAVE BROKEN UP. STATED [redacted] HAS BEEN VERBALLY HARASSING HER SON STATED SHE IS CONCERNED FOR HER SON AFTER FATHER TEXTED HER TELLING HER TO KEEP HER SON AWAY FROM HIS DAUGHTER. - NEGATIVE ON ANY PC 422 FROM [redacted] AT THIS TIME. - WAS ADVISED I WOULD COUNSEL BOTH JUVENILES. - STUDENT NOT AT SCHOOL TODAY - I SPOKE WITH [redacted] AT SCHOOL IN REF TO THREAT.
