Incident details:

Upon arrival I contacted (the owner of the black Nissan Frontier) who was approaching the vehicle. I asked him if the Black Nissan Frontier was his. He stated that it was. I advised him that someone had seen him drinking alcohol inside his vehicle and asked him if he had an open alcohol container inside the vehicle. ••111111stated that he had been drinking. When I asked him for his California driver's license, he stated that he did not have one issued to him. He stated that he only had a Mexican Consular card. Upon searching his vehicle, I found an open 24 oz Modelo Especial beer can with approximately 3/4 of its contents empty inside the center console of his vehicle. When I showed llllllllllllthe beer can, he smiled and stated that he only had one while waiting to pick up his daughter at school. I advised him that it was illegal for him to be drinking in public and could be dangerous for not only him and his daughter but for other motorist and pedestrians out in public if he's driving intoxicated. stated that he knew he should not have been drinking in his vehicle and should have waited to get home. Due to not having a valid California driver's license, I took possession of his car keys. I issued Hernandez a citation #012614 for California Vehicle Code section violation's 23223(a) Open alcohol container and 12500(a) Unlicensed Driver with a promise to appear in court with a date of 05/25/23. With consent, I released his Nissan Frontier to his friend, with a valid California driver's license # and instructed him not to drive until he obtains a valid California driver's license.
